These Terms of Service ("Terms") govern your access to and use of the NinePlay mobile application, the website at nineplay.win, and related services (collectively, the "Service"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. About NinePlay
NinePlay is a local-first multi-video player designed to play and compare as many as nine videos on one screen. Depending on the version and device, features may include independent track controls, synchronized playback, per-track time offsets, frame stepping, loops, slow motion, saved sessions, and compare exports.
2. Eligibility
You may use the Service only if you can form a binding agreement under applicable law. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. License to use the Service
Subject to these Terms, NinePlay grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to install and use the Service for lawful personal or professional purposes. We and our licensors reserve all rights not expressly granted to you.
4. Your videos and other content
You keep ownership of the videos, audio, images, metadata, session names, exports, and other content you select, import, create, save, or share using the Service ("User Content"). NinePlay does not claim ownership of your User Content.
You are responsible for your User Content and for having all rights, licenses, permissions, and consents needed to play, compare, edit, export, publish, or share it. Your use must comply with copyright, privacy, publicity, recording, sports-venue, employment, and other laws or rules that apply to the people, places, brands, music, or footage in your content.
5. Local processing, saved sessions, and backups
NinePlay is designed to process selected videos on your device. Saved sessions may contain local file references and other details needed to reopen your videos, and are stored on your device. Moving, renaming, deleting, or revoking access to a source file may prevent a saved session from loading correctly.
You are responsible for maintaining backups of original videos, saved sessions, and exported files. To the extent permitted by law, NinePlay is not responsible for loss, deletion, corruption, failed exports, or unavailable local files.
6. Permissions
Some features require permission to access videos, the photo library, or media storage. You may deny or revoke permission, but features that depend on that access may no longer work. NinePlay will not require access unrelated to a feature you choose to use.
7. Acceptable use
You agree not to:
- Use the Service for unlawful, harmful, abusive, or fraudulent activity.
- Violate intellectual-property, privacy, publicity, or other rights.
- Record, monitor, analyze, or distribute footage where doing so is prohibited or where required consent has not been obtained.
- Reverse engineer, copy, modify, or distribute the Service except as permitted by applicable law or an applicable open-source license.
- Interfere with, disrupt, overload, or abuse the Service or related systems.
- Circumvent purchase validation, manipulate advertising or analytics, or fraudulently interact with ads or app-store systems.
- Misrepresent NinePlay, our relationship with you, or the source of User Content.
8. Device capability and playback performance
NinePlay can offer layouts for up to nine simultaneous videos, but the number, resolution, codecs, and frame rates a device can play smoothly depend on its hardware-decoder capacity, thermal state, memory, operating system, and the source files. Performance varies by device and chipset. A device may reduce performance, fail to decode a track, or support fewer simultaneous streams without an app error.
We do not guarantee frame-perfect output for every combination of files or hardware. Variable-frame-rate media, damaged files, unsupported codecs, imprecise source timestamps, wireless storage, and operating-system behavior can affect synchronization, seeking, frame stepping, playback, or exports. You should independently verify results before relying on NinePlay for coaching, evidence, safety, professional decisions, or other consequential uses.
9. Third-party services, formats, and platforms
The Service may rely on operating systems, device media libraries, app stores, codecs, open-source components, sharing destinations, Google Firebase, Cloudflare, purchase-validation services, or advertising providers. These third parties may have their own terms, privacy policies, fees, format support, and availability rules. We are not responsible for third-party services or for changes they make.
10. App stores
If you obtain NinePlay through Google Play, the Apple App Store, or another store, your use is also subject to that store's terms. The store may handle downloads, updates, purchases, restoration, refunds, and certain diagnostics under its own rules.
11. Pro lifetime unlock and billing
NinePlay offers an optional one-time, non-consumable entitlement called the "NinePlay Pro lifetime unlock." NinePlay does not require a subscription. The advertised U.S. list price is USD 5.99, but the final price, currency, taxes, and availability shown by your app store at the time of purchase control and may vary by country, platform, or store.
- What Pro includes. Pro removes advertising from the app. Additional benefits may be added later. Unless clearly stated otherwise at the time of purchase, core playback features—including access to layouts for up to nine tracks on capable devices—are not restricted to Pro.
- Payment. Purchases are processed by the applicable app store. By purchasing, you also agree to that store's payment terms.
- Restoration. You can restore an eligible purchase using the same app-store account and platform used for the original purchase, subject to store rules and technical availability.
- Refunds. Refund requests are handled by the app store under its policies and applicable law. We generally cannot directly issue an app-store refund.
- Meaning of lifetime. "Lifetime" means the supported commercial lifetime of the NinePlay app, not the lifetime of any person, device, platform, or app store. It does not guarantee that the app, every feature, or every platform will remain available indefinitely. Mandatory consumer rights are not affected.
12. Advertising and analytics
The free version of NinePlay may display advertising in the future. The Pro lifetime unlock removes ads. NinePlay may use analytics and crash reporting to understand feature use, diagnose problems, and improve reliability. Data practices are described in our Privacy Policy.
You may not block, alter, manipulate, automate, or fraudulently interact with ads, consent controls, purchase checks, measurement systems, or fraud-prevention mechanisms in a way that violates law or applicable provider terms.
13. Updates and changes to the Service
We may update, modify, suspend, or discontinue all or part of the Service. Updates may add, change, or remove features or format support, and you may need to install updates to continue using some features. We will not intentionally remove mandatory rights attached to a valid purchase, except as permitted by applicable law and app-store rules.
14. Intellectual property
The Service, including its software, design, branding, and documentation, is owned by NinePlay or its licensors and is protected by intellectual-property laws. Third-party and open-source components remain subject to their respective licenses. These Terms do not grant you rights to use NinePlay's trademarks or branding except as needed to identify the Service.
15. No warranties
To the maximum extent permitted by law, the Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, availability, accuracy, synchronization, format compatibility, or reliability.
We do not warrant that the Service will be uninterrupted, secure, error-free, compatible with every device or file, or suitable for medical, legal, safety-critical, evidentiary, or professional decisions. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
16. Limitation of liability
To the maximum extent permitted by law, NinePlay and its developer, affiliates, licensors, service providers, and partners will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, User Content, goodwill, or business opportunity arising from or related to the Service.
To the maximum extent permitted by law, our total liability for claims arising from or relating to the Service will not exceed the greater of the amount you paid for the Service during the twelve months before the event giving rise to the claim or USD 50. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
17. Indemnity
To the extent permitted by law, you agree to defend, indemnify, and hold harmless NinePlay and its developer, affiliates, licensors, service providers, and partners from claims, damages, losses, liabilities, costs, and expenses arising from your User Content, your unlawful use of the Service, your violation of these Terms, or your violation of another person's rights. This section does not apply where prohibited by law.
18. Suspension and termination
You may stop using the Service at any time. We may suspend access to online components or discontinue distribution if required by law, if you materially violate these Terms, or if continued operation creates legal, security, or technical risk. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limitations of liability, indemnity, and dispute-related provisions.
19. Governing law and consumer rights
These Terms are governed by applicable law, without excluding any mandatory consumer-protection rights that apply in your country or region of residence. Nothing in these Terms limits rights that cannot be waived by contract. Before filing a formal claim, you and NinePlay agree to try in good faith to resolve the issue by email, unless the law allows you to proceed directly.
20. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date and provide additional notice where required. Your continued use of the Service after updated Terms become effective means you accept the updated Terms to the extent permitted by law.
